Assessor Terms & Conditions
These terms govern your engagement as a Domestic Energy Assessor (DEA) with Move-Nest Property Limited (Company No. 16708319, registered in England & Wales). By submitting an application and accepting job offers through the Move-Nest platform, you agree to these terms in full.
1. Status of Engagement
- 1.1You are engaged as an independent contractor, not an employee, worker, agent, or representative of Move-Nest Property Limited ("Move-Nest").
- 1.2You provide EPC services directly to the customer, and Move-Nest acts only as an introducer and booking facilitator.
- 1.3You are responsible for your own tax, National Insurance, equipment, travel, insurance, training, and accreditation compliance.
2. Professional Standards & Compliance
- 2.1You warrant that you are a fully qualified and accredited Domestic Energy Assessor ("DEA").
- 2.2You will conduct all assessments with reasonable skill and care, and in full compliance with: EPC Regulations; RdSAP methodology and conventions; your accreditation body's rules; applicable UK laws and industry standards.
- 2.3You are solely responsible for the accuracy, legality, and validity of all EPCs you lodge.
- 2.4Move-Nest does not supervise, control, or review your inspection process or EPC reports.
3. Move-Nest's Role (Disclosed Agent)
- 3.1Move-Nest does not provide EPC assessments.
- 3.2Move-Nest acts solely as a booking, payment, and administration platform.
- 3.3Move-Nest's obligations are limited to: passing customer booking details to you; handling payment collection; facilitating communication where necessary.
- 3.4The contract for EPC services is between you and the customer, not Move-Nest.
4. Scheduling & Conduct
- 4.1You must attend all appointments you accept.
- 4.2Any delays, access issues, or cancellations must be notified immediately to both the customer and Move-Nest.
- 4.3Professional conduct is required at all times.
5. Customer Communication
- 5.1You are the named assessor on the EPC and responsible for explaining your lodged report if asked.
- 5.2Move-Nest does not interpret EPCs or provide EPC advice.
- 5.3You must respond to customer or Move-Nest enquiries within 48 hours.
6. Insurance Requirements
- 6.1You must maintain: Professional Indemnity Insurance (PII); Public Liability Insurance (PL).
- 6.2These must meet or exceed your accreditation body's requirements.
- 6.3You must provide evidence on request.
7. Fees & Payment
- 7.1You will be paid the agreed assessor rate per completed job.
- 7.2Payment is typically made within 2 working days of job lodgement.
- 7.3If a complaint, quality concern, or failure to lodge is reported, Move-Nest may temporarily hold payment pending resolution.
- 7.4If a full refund must be issued due to your error or conduct, Move-Nest may deduct or recover the relevant amount from you.
8. Liability
- 8.1You are fully liable for: the inspection; all EPC data entered; the lodged certificate; regulatory compliance; any loss arising from your work.
- 8.2Move-Nest accepts no liability for your conduct, professional judgement, or lodged EPC.
- 8.3You indemnify Move-Nest against any claims, losses, or costs arising from your work.
9. Data Protection
- 9.1You must comply with UK GDPR and keep all customer information secure, confidential, and used only for the purpose of completing the service.
10. Confidentiality
- 10.1You must not disclose any non-public information relating to Move-Nest systems, customers, pricing, or operations.
11. Termination
- 11.1Either party may terminate with reasonable notice.
- 11.2Move-Nest may suspend or terminate immediately for: complaints; quality concerns; misconduct; failure to lodge; breach of any part of these terms.
12. Non-Poaching (12-Month Rule)
- 12.1You must not solicit, accept, or carry out any direct work for a Move-Nest customer outside the platform for 12 months from the job date.
- 12.2Breach may lead to permanent removal and recovery of lost fees.
13. Lodgement Timeframes
- 13.1EPCs must be lodged within 48 hours of inspection unless otherwise agreed.
- 13.2Delays may result in withheld payment or removal from the platform.
14. Disputes & Contact
- 14.1Move-Nest may share your details (name, phone number, email address, accreditation ID) with customers if a complaint is raised.
- 14.2You must respond within 48 hours.
15. No-Shows & Incomplete Jobs
- 15.1Failure to attend an appointment without notice may result in reassignment and withheld payment.
- 15.2Repeated failures will result in removal from the platform.
16. Governing Law
- 16.1These Terms are governed by the laws of England, Scotland, Wales and Northern Ireland.
